This Privacy Policy explains how Shapecrunch Technology Pvt Ltd ("Shapecrunch", "we", "us", or "our") collects, uses, stores, shares, and protects your personal information when you use the Shapecrunch measurement application for iOS (the "App") and related services, including custom orthotics and footwear ordering.

We are committed to protecting your privacy and handling your data in a lawful, fair, and transparent manner. By using the App, you agree to the practices described here.

2. Information We Collect

We collect the following categories of personal information:

Foot images and scan data. Photographs and measurement scans of your feet that you capture using the App. These are used to generate accurate measurements for custom orthotics and footwear. Depending on how this data is used in your jurisdiction, foot images and derived measurements may be treated as health-related or biometric information.

Personal identifiers. Your name, email address, phone number, and shipping/billing address, where provided.

Health-related information. Information you choose to share about foot conditions, pain, medical history, podiatry needs, or related symptoms, where relevant to providing orthotic products and recommendations.

Device and technical information. Device type, operating system version, app version, and basic diagnostic data needed for the App to function.

We do not knowingly collect data from anyone we know to be under the age of 16 (or the applicable age of consent in your jurisdiction). See Section 11.

3. How We Use Your Information

We use your information to:

  • Generate foot measurements and produce custom orthotics or footwear;

  • Process and fulfil your orders and provide customer support;

  • Communicate with you about your orders, account, and service updates;

  • Improve the accuracy and performance of our measurement technology;

  • Comply with legal, regulatory, and tax obligations;

  • Detect, prevent, and address fraud, security issues, and technical problems.

We do not sell your personal information. We do not use your foot images, scans, or health information for advertising.

4. Legal Bases for Processing (GDPR / UK GDPR)

If you are in the European Economic Area or the United Kingdom, we process your personal data on the following legal bases:

  • Consent — for processing foot images, scans, and health-related information, which may constitute special category data under Article 9 GDPR. You may withdraw consent at any time.

  • Performance of a contract — to fulfil orders and provide the products and services you request.

  • Legal obligation — to comply with applicable laws.

  • Legitimate interests — to improve our services and ensure security, provided these interests are not overridden by your rights.

5. How We Share Your Information

We share personal information only as necessary, with:

  • Manufacturing and fulfilment partners who produce and deliver your custom orthotics and footwear;

  • Service providers who support our operations (e.g. cloud hosting, payment processing, customer support tools), under contractual confidentiality and data protection obligations;

  • Professional advisers and authorities where required by law or to protect our legal rights.

We require all third parties to safeguard your data and to use it only for the purposes we specify.

6. International Data Transfers

Your information may be processed in countries other than your own, including India and other jurisdictions where we or our service providers operate. Where we transfer data internationally, we implement appropriate safeguards (such as Standard Contractual Clauses or equivalent legal mechanisms) to protect your information in accordance with applicable law.

7. Data Retention

We retain your personal information only for as long as necessary to fulfil the purposes described in this policy, including order fulfilment, legal and accounting obligations, and dispute resolution.

8. Data Security

No method of transmission or storage is completely secure, but we work to protect your data using industry-standard practices.

9. Your Rights

Depending on your jurisdiction, you may have the right to:

  • Access the personal information we hold about you;

  • Correct inaccurate or incomplete information;

  • Delete your personal information;

  • Withdraw consent where processing is based on consent;

  • Object to or restrict certain processing;

  • Request a portable copy of your data;

  • Lodge a complaint with a supervisory authority.

For California users (CCPA/CPRA): You have the right to know what personal information we collect, to request deletion, to correct inaccurate information, and to opt out of any "sale" or "sharing" of personal information. We do not sell or share your personal information as those terms are defined under the CCPA. We will not discriminate against you for exercising your rights.

For India users (DPDP Act, 2023): You have the right to access, correction, and erasure of your personal data, the right to grievance redressal, and the right to nominate another individual to exercise your rights in the event of death or incapacity.

10. Apple App Store Disclosures

The App is distributed through the Apple App Store. In line with Apple's requirements:

  • The data we collect and how it is used is summarised on the App's App Store product page ("App Privacy" / Privacy Nutrition Label).

  • The App requests permission to access your camera to capture foot images for measurement. You can manage this permission at any time in your device Settings.

  • We do not use third-party tracking that links your activity across other companies' apps and websites for advertising purposes.

11. Children's Privacy

The App is not directed at children. We do not knowingly collect personal information from children under the age of 16 (or the applicable minimum age in your jurisdiction) without verifiable parental or guardian consent. If you believe a child has provided us with personal information, contact us and we will delete it.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version here with a revised "Last updated" date and, where required, notify you of material changes.
